In Mexico, a notario publico is a government-appointed legal officer who must oversee every property transaction. Choosing the right notario -- or allowing the developer to choose one without scrutiny -- is one of the most consequential decisions a foreign buyer makes.
In Mexico, either party can propose the notario, but the buyer has the right to insist on their own choice. Developers often push buyers toward their preferred notario -- who may have conflicting loyalties. Always retain the right to select an independent notario or at minimum engage your own independent legal counsel to review the escritura.
